Request to the Election Commission to take action against the Bhartiya Janta Party, Prime Minister Narendra Modi, Home Minister Amit Shah, Defence Minister Rajnath Singh, Minister of External Affairs and National Security Advisor Ajit Doval for violating Article 51(c) of the Indian Constitution, Section 121, 124A, 153A of the Indian Penal Code, Section 3 (2) (ii) of the National Security Act and as an unlawful activity under Section 2 (d) (iii) of the Unlawful Activities Prevention Act, by stating that India has/will breach the sovereignty of other nations to carry out killings.

Rajnath Singh the Defence Minister seconded the Prime Ministers statement by stating “If terrorists try to disturb peace in India or carry out terror activities, a befitting response will be given and if they run away to Pakistan, India will enter the neighbouring country to kill them, Defence Minister Rajnath Singh said on Friday.” As per the PTI New Delhi, April 5.
As justification for the Prime Minister and Defence Minister the External Affairs Minister S. Jaishanker has stated that “Terrorists do not play by any rules. The response to terrorists cannot have any rules.” STN New Delhi, April 14.
The justification by Minister S. Jaishanker violates the principles of International Humanitarian Law (or the Law of War) such as the Principle of Distinction (between civilians and combatants), Prohibition of Direct Attack on Civilians, Prohibition of Threats of Violence and the Protection of the Fundamental Human Right to Life and Dignity. Article 2(4) of the UN Charter prohibits the threat or use of force by one state against another state, thus causing India to commit the crime of aggression which is defined by Article 8 (b) of the Rome Statute of the International Criminal Court (ICC),
The same statements can be held to show intent to violate the Geneva Conventions I through IV having to do with the protections of civilians, non combatants, medical and humanitarian personnel and the protection of Prisoners of War and the prohibition of torture and Inhumane Treatment.
These statements show a special bias towards the Sikhs and Punjab. The Canadian Prime Minister categorically spoke to Prime Minister Narendra Modi about the state sponsored extra judicial killing of Bhai Hardeep Singh Nijjar for which the Indian Prime Minister denied any such violation of International Law, Human Rights Law, International Humanitarian Law and violations of the United Nations Charter.
Subsequently on the United States of America confirming the Canadian Prime Ministers assertion, and filing a case in the United States Courts for the attempted assassination of Bhai Gurpatwant Singh Pannu, the Prime Minister meekly submitted to the charges and has brought India into a position where it can be sanctioned as per United Nations Charter, International Humanitarian Law, the Law of Nations and Human Rights Law. Thus tarnishing India’s standing with friendly law abiding nations.
The assertions above by the BJP and Cabinet Ministers further shows their intent to carry on these unlawful extrajudicial violation of the Laws of Nations, Human Rights and International Humanitarian Law, while these same actions violate the Indian Constitution and the Law of the Land. The government is becoming the Judge, Jury and Executioner, thereby subverting the Rule of Law towards becoming an autocracy.
It is pertinent to mention that this warmongering has a huge deleterious effect against Punjab and India.
The Punjab border is an international border and every time the spectre of war is raised by cross border actions, the entire population of Punjab, on both sides of the border, suffers immense loss of security, People flee their homes, livestock, fields and work, becoming displaced refugees in their relatives homes in the Interior. This is in response to the threat of a conventional war.
The scale of destruction from a Nuclear war is so immense, that people cannot comprehend the danger to their lives and livelihood.
Even the Red Cross and other Humanitarian agencies do not have a protocol to deal with Nuclear war, other than forbidding their personnel from working in a Nuclear War zone.
Such a war will have the effect of eliminating the entire religion, culture, history and shrines of the Sikh civilisation.
This ethnocide will not destroy any other ethnicity as major pockets of their populations exist in other regions which will survive war.
The effect on trade, which is the lifeblood of modern nations is immense. Prior to partition both Punjab had a trade of over 70% with each other. Now it is non existent. This unlawful aggression displayed by the Prime Minister and his Cabinet of the BJP is ignoring the rules of trade by shutting borders and depriving the GDP of India a boost of 1%, which has the power to alleviate the poor and boost good relations amongst neighbour.
It is our hope that the election commission will put a stop to this unlawful aggression and work to towards the comity and goodwill of peoples across nations as enshrined in Article 51 (C) of the Constitution and International-bodies such as the United Nations. In sum it will pursue the dictum “Make Trade, Not War.
