Comments by Simranjit Singh Mann: Shiromani Akali Dal (Amritsar) states that our party welcomes the G20 meeting that will take place in Jammu & Kashmir.
However, the omnipotent rightwing Union Government of the BJP-RSS led by Premier Narinder Modi has killed the sprit and soul of the Kashmiri peoples. In 2019 this omnipotent Union Government abrogated Articles 370 and 35A of the Constitution that gave a semblance of autonomy to Jammu & Kashmir.
It also reduced the status of this province from a state of the Union to that of an Union Territory governed and ruled directly from Delhi.
The Union Government also dissolved the legislature of this erstwhile territory with the result that the people have no access to direct democracy. Elections to this Union Territory are also being delayed for one reason or the other.
The Hindutva Union BJP-RSS Government has also introduced the barbaric law AFSPA (Armed Forces Special Powers Act) according to which the security forces can kill, maim, kidnap, abduct, murder, rape, molest, torture, detain any person for an endless time, with impunity.
This law contravenes Article 21 of the Constitution which states that no person can be deprived of his life and liberty without following the procedure laid down by law. Yet the Supreme Court which is the guardian of the Constitution is not willing to strike this inhuman law down and declare it ultra vires the Constitution.
Moreover, the national Human Rights Commission in Delhi is meant to be the watchdog of the Human Rights and their preservation. So far this Commission has taken no action against the violation of Human Rights and the beastly undemocratic law AFSPA (Armed Forces Special Powers Act).
We are sure that the members of the G20 visiting Jammu & Kashmir will come to know more about the miserable conditions prevailing in this Union Territory, much like what is happening to the Uygar people of Sinkiang of Communist China.
Perhaps the holding of the G20 meeting in Jammu & Kashmir and the comments of the members of this group will convince the rightwing Hindutva Union Government to restore the Constitutional position of this area as it existed prior to 5th August 2019.
Such fiats like the one of 5th August 2019 are usually passed by the President without the application of his or hers mind, whereas the Sarkaria Commission and the Supreme Court have passed judgments how a state is to be robbed of its Constitutional status and turned into an Union Territory, the legislature dissolved and governed without a popular government responsible to its legislature, but now arbitrarily governed by a Lt. Governor who along with the security forces keep the populace under their Jackboots, , denying them their basic Constitutional and Human Rights as laid down by The United Nations Commission on Human Rights.
