Comments by Simranjit Singh Mann: Shiromani Akali Dal (Amritsar) states that our party appreciates the action that the NHRC (National Human Rights Commission) has taken regarding encounter killings by armed forces in Jammu, Kashmir and Ladakh. It is a laudable step and should be extended to Chhattisgarh, Madhya Pradesh, Maharashtra, Orissa, Jharkhand, Bihar, Nagaland and the Punjab, where such encounters take place as the Central Forces are posted and active in these areas.
We would also request that whenever such encounters take place, they should be inquired into or investigated, where foul play is suspected, by Judicial Magistrates. Our party has experienced that the Executive Magistrates do not make truthful inquiries or investigations and the public is never satisfied. Justice should not only be done but seen to be done. Deaths caused by the armed forces where the law AFSPA(Armed Forces Special Powers Act) prevails, in such cases inquiries and investigations must always be entrusted to Judicial Magistrates.
Such changes will enhance the credibility of the NHRC and the public will gain trust in the law and the provisions of the Constitution and the Charter of the NHRC.
