Comments by Simranjit Singh Mann: Shiromani Akali Dal (Amritsar) states that Kashmir which is a disputed territory of the Hindu Union Government has been under quasi-military rule since 1947. In 1948 the United Nations Security Council in a resolution decreed that a plebiscite be held in this troubled territory. It was the Hindu Indian state that took the case for a plebiscite in Kashmir to the UNSC but when this body ruled that a plebiscite be carried out, after that the Hindu Indian state reneged from what it had sought from the UNSC.

Since 1947 this unfortunate minority Muslim state has suffered horrendous cases of criminal behaviour at the hands of the Hindu Indian state.

On 05th August 2019 the BJP-RSS radicalised Hindu state abrogated Articles 370 and 35A of the Constitution which gave a semblance of autonomy to this state. With this very stroke the Union Government dissolved the democratically elected legislature of the state. It also converted the status of Kashmir state as a state of the Union of Hindu India and turned it into an Union Territory of the Union, which is now ruled and governed by the extremist Hindu BJP-RSS Union Government of Premier Narinder Modi.

The last straw on the camels back is the promulgation of the barbaric law AFSPA (Armed Forces Special Powers Act) which gives draconian powers to the security forces to kill, maim, kidnap, abduct, murder, rape, molest, torture any Kashmiri with impunity. Though this law contravenes Article 21 of the Constitution, the tragedy is that the Supreme Court acts in tandem with the Executive, though the Supreme Court is the guardian of the Constitution. Therefore, such cases of extra judicial murders of the Kashmiri’s take place regularly; this one is one of the unique cases that have caught the sight of the Union Government to charge security personnel for such brutal murders for money.

In 2000 US President Bill Clinton visited the Indian sub-continent with his Secretary of State Ms. Madeline Albright. During this period of the Presidential visit the BJP-RSS Union Government and its Union Home Minister Mr. L.K. Advani had 43 innocent Sikhs massacred in Kashmir’s Village Chitthi Singhpura by the armed forces, whose names and ranks have been provided in our petitions to the Union and Kashmir state Governments. Our party since then has gone from pillar to post to seek Justice for these peacefully living Sikhs in the Kashmir Village but we have since this tragedy run into cul de sac, though Ms. Albright has written this episode in her memoirs. Though our party has been snubbed by the extremist Hindu Indian state on this issue, we have not accepted defeat and once again appeal to the Union Home Minister Mr. Amit Shah to have these murders by the armed forces probed and the culprits brought to justice.
